TheDeshi (operating at thedeshi.co.uk, hereafter “TheDeshi”, “we”, “our”, or “us”) respects the intellectual property rights of others and strictly requires all users, sellers, vendors, merchants, buyers, and visitors to do the same.
This Intellectual Property & Takedown Policy explains how intellectual property complaints may be submitted and how TheDeshi responds to claims of copyright, trademark, patent, design right, and other intellectual property infringement across our marketplace.
Intellectual property rights protected under this policy include, but are not limited to:
Copyrights (including imagery, text, and artwork)
Trademarks and Service Marks
Trade Dress
Patents
Design Rights
Trade Secrets
Proprietary content and materials
Sellers are solely responsible for ensuring that all products, images, descriptions, logos, branding, and other content they upload to TheDeshi do not infringe upon the legal rights of any third party.
To maintain a trusted marketplace, users and sellers must not:
Sell counterfeit, unauthorized, or replica products.
Use copyrighted images, videos, text, or artwork without explicit authorization.
Use another company’s trademark, logo, or brand name without legal permission.
Copy product listings, descriptions, or imagery from competitors without authorization.
Misrepresent generic or unauthorized products as genuine.
Infringe any intellectual property rights belonging to another person or business entity.
If you are a rights owner (or their authorized representative) and believe that content or products listed on TheDeshi infringe your intellectual property rights, you may submit a formal written notice to our Intellectual Property Team at [Insert Email Address, e.g., ip@thedeshi.co.uk].
Your notice must include the following information:
A. Contact Information
Full legal name
Company name (if applicable)
Mailing address
Telephone number
Email address
B. Identification of the Intellectual Property A detailed description of the intellectual property right claimed to be infringed, including:
Copyright, trademark, patent, or design registration numbers (if applicable).
Jurisdiction of registration (e.g., UK IPO, EUIPO).
Links to official registrations or supporting documentation.
C. Identification of the Infringing Content Please provide exact details so we can locate the material:
Product title
Exact Product URL(s)
Seller/Vendor name (if known)
A clear description of the allegedly infringing material.
D. Statement of Good Faith You must include the following statement:
"I have a good faith belief that the disputed use of the intellectual property is not authorized by the rights owner, its agent, or the law."
E. Accuracy Statement You must include the following statement:
"The information in this notice is accurate, and I declare under penalty of perjury that I am the intellectual property owner or authorized to act on behalf of the owner."
F. Signature A physical or electronic signature of the rights holder or their authorized representative.
Upon receiving a complete and valid infringement complaint, TheDeshi may take the following actions:
Review the complaint and submitted supporting evidence.
Temporarily remove or disable public access to the disputed content or listing.
Contact the seller to notify them of the complaint and request additional information or proof of authorization.
Permanently remove the infringing content if no valid defense is provided.
Suspend or terminate the accounts of sellers who violate this policy.
Note: TheDeshi reserves the right to act immediately and without prior notice when necessary to protect intellectual property rights or comply with legal obligations.
If you are a seller and believe your content or listing was removed in error or due to misidentification, you may submit a formal counter-notice. Your counter-notice must contain:
Your full legal name and business contact information.
Identification of the specific content that was removed and the URL where it previously appeared.
A detailed explanation of why you believe the content was removed incorrectly.
Documentation or evidence supporting your legal right to use the material.
A statement made in good faith that the content was removed due to a mistake or misidentification.
Your physical or electronic signature.
TheDeshi will review the counter-notice and, at our sole discretion and where legally appropriate, may restore the removed content or listing.
TheDeshi maintains a strict zero-tolerance policy for repeat intellectual property offenders. Accounts that repeatedly infringe the intellectual property rights of others may be subject to:
Immediate listing removal.
Selling and withdrawal restrictions.
Temporary account suspension.
Permanent account termination.
Withholding of funds where permitted by law to cover potential chargebacks or legal claims.
By listing products on TheDeshi, sellers represent and legally warrant that:
They own or possess the necessary licenses and permissions to use all intellectual property associated with their listings.
Their products and uploaded content do not infringe any third-party rights.
They will cooperate fully and promptly with any investigations regarding infringement claims.
Sellers remain legally and financially responsible for all content they publish and all products they offer for sale on the Platform.
TheDeshi operates strictly as an intermediary online marketplace facilitating sales between third-party sellers and buyers.
We do not independently verify the ownership of intellectual property associated with every user-generated listing and are not liable for seller-generated content. However, upon receiving valid and actionable infringement notices, TheDeshi is committed to taking swift and appropriate action consistent with this Policy and applicable UK law.
Submitting false, misleading, or fraudulent intellectual property complaints is strictly prohibited and legally actionable.
If we determine that the takedown process is being abused, TheDeshi reserves the right to:
Reject abusive or incomplete complaints.
Restore improperly removed content.
Suspend or ban users who repeatedly submit bad-faith notices.
Pursue legal remedies and damages against the abuser where appropriate.
